Chivayo allegedly did not implement the plan but converted or transferred the money to several individual accounts and company accounts.
The State claims that Chivayo was also authorized by the Zimbabwean Inventory Bank to ship $ 849,479 to Visa cards for the import of earthmoving equipment from the United States.
However, it was argued that Chivayo did not notify the Exchange Control Authority of all the essential facts concerning the importation of this equipment in Zimbabwe and that nothing was entered.
ZPC suffered a loss of $ 5,607,814.24 and nothing was recovered.
